Privacy Policy (POPIA compliant)
How we collect, use and protect your personal information under the Protection of Personal Information Act, 2013 (POPIA).
ElephTV South Africa (“we”, “us”, “our”) is the responsible party for the personal information collected through elephtv.store. We comply with the Protection of Personal Information Act, 2013 (Act 4 of 2013) (“POPIA”) of South Africa.
1. Information we collect
- Account & order details — name, email, WhatsApp number, password (hashed), city/province.
- Payment information — handled by our payment processor (e.g. PayPal). We do not store full card numbers.
- Activation & usage — activation codes issued to your account, order history, support tickets.
- Technical data — IP address, device type, browser, and pages visited (for security and analytics).
2. Why we process it (lawful basis under POPIA s.11)
- To fulfil your order and deliver activation codes by email and WhatsApp.
- To provide customer support and replace codes that do not work.
- To prevent fraud, abuse and unauthorised access.
- To comply with legal and tax obligations in South Africa.
- With your consent — for occasional product updates (you can opt out at any time).
3. Your rights under POPIA
You have the right to:
- Access the personal information we hold about you.
- Request correction or deletion of inaccurate or unnecessary data.
- Object to processing or withdraw consent for marketing.
- Lodge a complaint with the Information Regulator (South Africa) at inforegulator.org.za.
To exercise any of these rights, contact us at sales@elephtv.store or on WhatsApp. We respond within 30 days.
4. Sharing & third parties
We only share personal information with operators that help us run the service:
- Payment processors (PayPal) to take payment.
- Email and WhatsApp delivery providers to send your activation code.
- Hosting and database providers that store your account securely.
- Law enforcement when legally compelled to do so.
We never sell your personal information.
5. Cross-border transfers
Some of our operators store data outside South Africa. Where this happens we ensure an adequate level of protection as required by POPIA s.72 (binding agreements or equivalent privacy laws).
6. Security
We use encryption in transit (HTTPS), hashed passwords, role-based database access and row-level security to protect your information. No system is perfectly secure, but we apply reasonable technical and organisational measures.
7. Retention
Order and billing records are kept for at least 5 years to meet South African tax and consumer-protection requirements. Account data is removed on request once any outstanding obligations are concluded.
8. Children
The service is intended for users 18 years or older. We do not knowingly collect personal information from children without parental consent.
Refund Policy — no refunds, free replacements
Because activation codes are digital and delivered instantly, we do not offer refunds. We do replace codes that don't work, free of charge.
No refunds policy. All sales of activation codes and subscriptions are final and non-refundable. This applies whether or not the code has been used.
Why we have this policy
ElephTV codes are unique 16-digit credentials generated and reserved the moment you pay. Once a code is issued we cannot resell or recover its value, so refunds are not possible — even if you change your mind after purchase.
Try before you buy — the 7-day free trial
This is exactly why we strongly encourage every new customer to use the 7-day free trial first. Seven days is more than enough time to:
- Install the app on your Android phone, TV, box or stick.
- Test channels, on-demand titles and your internet speed.
- Confirm everything works on your devices.
Only buy a paid code once the trial has proven the product works for you.
Free code replacement
If a code you bought from us does not activate or stops working inside its paid period due to a fault on our side or the provider's side, we will replace it at no cost. To request a replacement:
- Message us on WhatsApp or email sales@elephtv.store.
- Include your order number and the code that failed.
- We’ll verify with the provider and reissue a working code, usually within hours.
What is not covered
- Buyer’s remorse or change of mind.
- Lack of suitable internet at your location (we publish minimum-speed guidance on the site).
- Use on unsupported devices — only Android is supported (see Devices).
- Codes shared, resold or used outside the terms of service.
Chargebacks
Please contact us first if anything is wrong — we resolve almost every issue with a free replacement. Unjustified chargebacks may result in the affected codes and account being suspended.
Terms of Service
The basic rules for using elephtv.store and the activation codes we sell.
1. Who we are
ElephTV South Africa is an authorised reseller of ElephTV activation codes operating from South Africa. We sell access codes only — we do not host, produce or distribute the streamed content (see the Content Disclaimer below).
2. Your account
- You must be 18 years or older to buy a subscription.
- Keep your login details secure. You are responsible for activity under your account.
- One activation code is for one household. Codes may not be shared, resold or used commercially without our written permission (resellers should join the reseller program).
3. Service availability
We aim for high uptime but cannot guarantee the streaming service will be free from interruption. Outages caused by the upstream provider, your internet, your device or third parties are outside our control. Where an outage materially affects your subscription we will work with the provider to extend or replace your code.
4. Payments
Prices are shown in South African Rand. Payment is processed by PayPal or the method shown at checkout. By paying you authorise us to issue a code against the order and accept the no-refunds policy above.
5. Liability
To the maximum extent allowed by South African law (including the Consumer Protection Act), our total liability for any claim is limited to the amount you paid for the affected order. We are not liable for indirect or consequential loss.
6. Governing law
These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in South African courts.
7. Changes
We may update these terms from time to time. Material changes are posted on this page with a new “last updated” date.
Content Disclaimer
What we sell and what we don't.
ElephTV South Africa is a reseller. We sell the ElephTV application and 16-digit activation codes that unlock access to channels and on-demand titles provided by independent upstream content providers.
What we provide
- The ElephTV Android app (download links and install guidance).
- An activation code that unlocks access to the app’s features for the period you paid for.
- Customer support, code replacement and setup help.
What we do not provide
- We do not own, host, produce, encode or broadcast any of the channels, films, series or other media available through the app.
- We are not responsible for the availability, quality, legality, licensing or content of any specific channel or title — those are the responsibility of the upstream providers and the rights holders.
- Channel line-ups, on-demand catalogues and stream quality can change at any time without notice.
Trademarks & copyright
All trademarks, logos and content shown inside the ElephTV app belong to their respective owners. We make no claim of ownership over any third-party content and display channel names and logos only for informational and identification purposes under fair use.
Reporting an issue
If you are a rights holder and believe content is being distributed without authorisation, contact us at sales@elephtv.store and we will pass the report to the upstream provider for action.
Acceptable Use Policy
The behaviours that get accounts and codes suspended.
When using ElephTV South Africa and the ElephTV app, you agree not to:
- Share, resell, sublicense or publicly redistribute your activation code.
- Attempt to reverse-engineer, scrape or interfere with the service.
- Use the service in a way that breaks South African law or the law of your country.
- Submit fraudulent payments or knowingly file unjustified chargebacks.
- Harass our support team or other users.
Breach of this policy may result in suspension of your account and codes without refund.
